Please read these Terms of Service carefully before placing an order or booking a service visit with Splash Cart NJ.
1. Acceptance of Terms
By placing an order on our website, scheduling a service visit, or otherwise using our services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.
2. Services We Offer
Splash Cart NJ provides mobile pool care services in Monmouth and Ocean Counties, NJ, including:
- Pool water testing (on-site analysis of pH, chlorine, alkalinity, and other parameters)
- Chemical delivery (poolside drop-off of the exact chemicals your water needs)
- Chemical treatment visits (we test, prescribe, and apply the chemicals for you)
- Problem-solver packs for common water issues (green water, yellow algae, cloudy water)
3. Delivery Terms
Delivery Window
We target delivery within 24 to 48 hours of order confirmation for addresses in Monmouth and Ocean Counties, NJ. Delivery windows may extend during peak season or due to weather.
Driver Access
Your pool area must be reachable by our driver without a locked gate, or you must provide your gate code in the order notes at checkout. If we cannot access the delivery location, we will attempt to contact you before leaving. If access cannot be arranged, we will reschedule at no additional charge.
Risk of Loss
Risk of loss or damage to products transfers to you upon delivery confirmation. Delivery is confirmed when our driver marks the order as delivered or when a delivery photo is taken at the drop location.
4. Chemical Handling
Pool chemicals are effective when used correctly, and potentially hazardous when they are not. By accepting delivery or using chemicals we apply, you agree to the following:
- Read and follow all product label instructions before handling or adding any chemical to your pool.
- Do not mix chemicals with each other outside of the pool water. Add chemicals separately, one at a time, following the directions on each label.
- Store chemicals safely. Keep all pool chemicals in a cool, dry place, out of reach of children and pets, and away from heat or open flame.
- Wear protective equipment. Gloves and eye protection are recommended when handling concentrated chemicals.
- Ventilate enclosed spaces. If your pool is in an enclosed structure, ensure adequate ventilation before and during chemical application.
Splash Cart NJ is not liable for injury, property damage, or pool damage resulting from improper handling, storage, or application of chemical products.
5. Service Visit Terms
Pool Access and Condition
For service visits, your pool must be:
- Accessible: pool area reachable, gate code provided if needed
- Filled to minimum water level: we cannot safely test or treat a pool with insufficient water
Scope of Service
We test and treat your pool to its current water chemistry. Service visits address water balance and chemistry only. Major repairs (including but not limited to liner replacement, pump or filter repair, plumbing work, or structural issues) are outside our scope and should be handled by a licensed pool contractor.
Customer Responsibility Between Visits
You are responsible for covering the pool as directed between service visits to prevent rain dilution, debris, and UV degradation of chemicals. Failing to do so may affect treatment results.
6. Pricing and Payment
- All prices are displayed in US dollars.
- New Jersey sales tax (currently 6.625%) is calculated and added at checkout where applicable.
- Payments are processed securely by Stripe. We accept all major credit and debit cards.
- Your card is charged at the time of order placement for product orders. Service visits may be charged at the time of booking or at completion, as specified at checkout.
7. Cancellations
Product Orders
Orders can be cancelled for a full refund before they have been dispatched. Once an order is in transit or marked as out for delivery, it cannot be cancelled. Standard refund terms apply (see our Refund and Returns Policy).
Service Visits
Service visits may be cancelled without charge up to 24 hours before the scheduled visit time. Cancellations made with less than 24 hours notice may be subject to a trip fee at our discretion, which will never exceed the cost of the service booked.
8. Limitation of Liability
Liability cap. Splash Cart NJ’s total liability to you for any claim arising from a product purchase or service visit is limited to the amount you actually paid for the specific product or service giving rise to that claim.
Exclusions. To the fullest extent permitted by New Jersey law, Splash Cart NJ is not liable for indirect, incidental, special, or consequential damages, including loss of use of your pool, loss of enjoyment, or costs of substitute services.
These limitations apply whether a claim is based in contract, tort, or any other legal theory.
9. Governing Law and Venue
These Terms of Service are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-law principles.
Any dispute arising under or relating to these Terms shall be resolved exclusively in the state or federal courts sitting in Monmouth County, New Jersey. Both parties consent to the personal jurisdiction of those courts.
There is no mandatory arbitration clause. You have the right to bring claims in court.
10. Changes to These Terms
We may update these Terms of Service from time to time. When we do, we will update the effective date at the top of this page. Changes apply to orders placed after the updated effective date. We encourage you to review these Terms before placing each order.
